What is Naturalization?

Naturalization is the process by which a foreign citizen or national is granted U.S. citizenship. In order to become naturalized, a candidate must fulfill the requirements established by Congress in the Immigration and Nationality Act (INA). An immigration attorney can help you determine whether you are eligible to apply for naturalization.

Who is Eligible for Naturalization?

To be eligible for U.S. naturalization, you must meet specific requirements. These requirements include:

  • You must be 18 years of age or older.
  • You must have been a lawful permanent resident of the United States for at least five years; if you are married to a U.S. citizen, you must have been a permanent resident for at least three years and meet all other eligibility requirements.
  • You have been physically present in the country for periods that total at least half the length of your residence.
  • You have qualifying service in the United States armed forces and meet all eligibility requirements.
  • Your child may qualify for naturalization if at least one parent is a U.S. citizen by birth or by naturalization and if your family meets other requirements.

There are other requirements and steps in order to be eligible for naturalization; an experienced immigration attorney can help you navigate the process.

Once you meet all the eligibility requirements, you can begin the naturalization process! To apply, you must fill out and file Form N-400. On average, it takes about six months to complete the naturalization process after the N-400 form is submitted, though this time frame can vary based on location and individual circumstances; therefore, you want to be certain you have filed everything correctly in order to avoid any setbacks.
